Rick McDuff is a member of the firm's Litigation group.  Prior to joining Smith Moore Leatherwood, Rick practiced law for more than 20 years as a Senior Partner with the law firm of Johnson, Anselmo, Murdoch, Burke, Piper & McDuff, P.A., in Fort Lauderdale, Florida.  In 1996, he obtained the designation of Board Certified Civil Trial Lawyer from the Florida Bar, and maintains an AV Rating in the Martindale-Hubbell Law Directory.  His practice has focused on Employment litigation, Constitutional litigation, and general business litigation.  His litigated cases have involved the 1st Amendment, 4th Amendment, and the Equal Protection and Due Process Clauses of the 14th Amendment to the Constitution of the United States, Title VII, 42 U.S.C. §1983, 42 U.S.C. §1981, the Americans With Disabilities Act (the ADA), the Family and Medical Leave Act (the FMLA), the Fair Labor Standards Act (the FLSA), the Equal Pay Act, the Rehabilitation Act of 1973, and the Florida Civil Rights Act (the FCRA). Rick has conducted more than 75 jury trials in both the state and federal trial courts, and has appeared in the United States Court of Appeals and the appellate courts on more than 25 occasions.  Some of his reported cases involved issues of first impression, and he has had the privilege of arguing an en banc case before the United States Court of Appeals for the Eleventh Circuit.  In addition to his trial work, Rick has counseled many private and public sector employers in personnel matters, and has guided employers through the EEOC process.  He has also handled collective bargaining negotiations and union arbitrations on behalf of employers.  He also has been frequently invited to lecture on employment-related matters, and provide in-house training for management personnel.
